These Terms of Use ("Terms") govern your use of https://digital-frame.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
What the Site is, and what it is not
The Site publishes general information about digital photo frames: getting photos onto a frame, screen terms, buying and gifting, apps, subscriptions, and privacy. We are not a retailer, a brand, a frame maker, or a photo service. We do not sell frames, subscriptions, apps, or any other product, and we do not provide technical support for any device.
General information only
Content on the Site is for general information. It is not professional, technical, security, or legal advice. Prices, features, file types, settings, plans, and availability are set by makers, services, and retailers, and they can change, including through software updates. A frame or app may not match an older description. Check the maker's manual, app, and terms, and the retailer's listing, before you buy.
Frame makers, apps, and third-party services
Frames, frame apps, and photo services (such as shared album platforms) are run by third parties under their own terms. Steps on the Site that come from a maker's or platform's help pages are that company's guidance, credited to it; we have not tested them, and they may change. We do not claim that any frame works with any phone, file type, app, or service. We are not responsible for a third party's devices, apps, services, outages, changes, or loss of photos or data.
Privacy of frame makers and photo services
Connected frames and frame apps may collect, store, and share information, including your photos, under the maker's or service's own privacy policy. The Site cannot tell you how any device or service handles your information, and we do not describe any frame or service as private, secure, or safe. Read the maker's and the service's privacy policy, and check app permissions and album sharing settings, before you connect a frame or share photos.
Subscriptions and free trials
Some frames and services offer paid plans or free trials. Plans, prices, renewal terms, and what works without a plan are set by the maker or service, not by us. Where the Site summarizes FTC consumer advice on trials, auto-renewals, or device security, it is a plain summary for general information, not legal advice, and the FTC's own pages control. Read the terms, including how and when to cancel, before you sign up.
Device and network security
Security steps on the Site are general and are drawn from FTC consumer advice. No step makes a device or network fully secure. You are responsible for your own devices, accounts, passwords, and network settings. Follow the maker's instructions for updates and settings.
Brand names and trademarks
Brand, product, and platform names mentioned on the Site belong to their owners. We use them only to identify a company's own features or to credit its help pages. The Site is not affiliated with, sponsored by, or endorsed by any brand it mentions, and a mention does not mean a product works with, or is equivalent to, any other product.

The Site is for a general audience. It is not directed to children under 13.
Acceptable use

Site content, design, and text are owned by us or our licensors and are protected by law. You may view and share links to the Site for personal, non-commercial use. Third-party names and trademarks are covered under "Brand names and trademarks" above.

Links to retailers, frame makers, platforms, and other websites are provided for convenience. We do not control those sites and are not responsible for their content, products, prices, or policies.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PURCHASE FROM A THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
Indemnification
You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.
Governing law and venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.
Assignment and change of operator
We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.
Changes
We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.
Miscellaneous
These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
